Firearm Releases
All firearms in the custody of the Port St. Lucie Police Department, either held as evidence or for safekeeping, will be handled according to Florida Statutes 790.08 and 933.14, with guidelines for return or disposal.
Eligibility for Firearm Return
- Forfeiture of Firearms: Firearms will not be returned if the owner is convicted of violating F.S.S. 790.07, related municipal ordinances, or any offense involving the use or attempted use of weapons. In these cases, firearms are forfeited to the state and transferred to the sheriff.
- Search Warrants and Convicted Felons: Firearms seized under a search warrant or owned by a convicted felon require a court order for return. This can be obtained through the St. Lucie County Clerk of the Circuit Court. Please note, the PSLPD cannot provide legal advice for this process.
- Medical Marijuana Prescription Holders: Under Federal Law (18 USC 922(g)(3)), individuals with a medical marijuana prescription cannot receive firearms. However, firearms may be released to a third party, contingent upon both parties agreeing to the third-party transfer terms.
Retrieval Process
Two appointments are required:
- First Appointment: You will complete paperwork for a background check through the Florida Department of Law Enforcement (FDLE). Processing times are determined by FDLE, not by the PSLPD.
- Second Appointment: Once approved, a second appointment will be scheduled to retrieve the firearm. A concealed weapons permit does not exempt the owner from the background check requirement.
